New rules on EPC’s
As of 1st April 2023, the rules on Energy Performance Certificates are changing.
Previously, an EPC was required for a building when it was to be sold or subject to a new lease. As of April 2023 it will be a requirement for all leased commercial property to hold a valid EPC.
The Minimum Energy Efficiency Standards (MEES) require a building to achieve an EPC rating within Class E or above to ensure that the building can continue to be legally let. An EPC rating within Classes F or G will mean that works will need to be undertaken to improve the energy efficiency of the building to achieve a rating which meets the minimum standard. Liability for any works will fall with the Landlord.
Failure to provide a valid EPC will result in fines being incurred, as well as still having the requirement to have an EPC prepared.
